ABOUT BIDAYAT AL-MUJTAHID WA NIHAYAT AL-MUQTASID:
Ibn Rushd's Bidayat al-Mujtahid occupies a unique place among the authoritative manuals of Islamic law. It is designed to prepare the jurist for the task of the mujtahid, the independent jurist, who derives the law and lays down precedents to be followed by the judge in the administration of justice.
In this manual Ibn Rushd traces most of the issues of Islamic law, describing not only what the law is, but also elaborating the methodology of some of the greatest legal minds in Islam to show how such laws were derived. This text provides a still-relevant basis for the interpretation and formulation of Islamic law. Combining his legal and philosophical knowledge, Ibn Rushd transcends the boundaries of different schools and presents a critical analysis of the opinions of the famous Muslim jurists and their methodologies. The legal subject areas covered include marriage and divorce; sale and exchange of goods; wages, crop-sharing and speculative partnership; security for debts and insolvency; gifts, bequests and inheritance; and offences and judgements.
Ibn Rushd was a Maliki Jurist (Qadi) but presents the views of other schools (Hanifi, Shaf'ee, hanbali & Zahiri) with the usual Respect and objectivity. This book is among the best known example of the Shari'a science of Ilm al Khilaf (the knowledge of variant ruling) It is one of the most well known works of ilm-ul- Khilaf, a discipline that records and analyses the differences among Muslim Jurists.

بداية المجتهد هو كتاب فقهي يحتوي على الفقه المقارن وقد ألفه الفيلسوف المالكي ابن رشد الحفيد، ويُعتبر من أفضل الكتب التي اشتملت على بيان أسباب الاختلاف بين العلماء في كل مسألة.
قال ابن رشد في مقدمة الكتاب: "فإن غرضي في هذا الكتاب أن أثبت فيه لنفسي على جهة التذكرة من مسائل الأحكام المتفق عليها والمختلف فيها بأدلتها، والتنبيه على نكت الخلاف فيها ما يجري مجرى الأصول والقواعد لما عسى أن يرد على المسائل المنطوق بها في الشرع أو تتعلق بالمنطوق به تعلقا قريبا، وهي المسائل التي وقع الاتفاق عليها أو اشتهر الخلاف فيها بين الفقهاء الإسلاميين من لدن الصحابة رضي الله عنهم إلى أن فشا التقليد."

ABOUT QADI IBN RUSHD:
Ibn Rushd, Abū l-Walīd Muḥammad Ibn ʾAḥmad Ibn Rushd, April 14, 1126 – December 10, 1198, often Latinized as Averroes was a medieval Andalusian polymath. He wrote on logic, Aristotelian and Islamic philosophy, theology, the Maliki school of Islamic jurisprudence, psychology, political and Andalusian classical music theory, geography, mathematics, and the medieval sciences of medicine, astronomy, physics, and celestial mechanics. Ibn Rushd was born in Córdoba, Al Andalus (present-day Spain), and died at Marrakesh in present-day Morocco. His body was interred in his family tomb at Córdoba. The 13th-century philosophical movement in Latin Christian and Jewish tradition based on Ibn Rushd's work is called Averroes.
Ibn Rushd was a defender of Aristotelian philosophy against Ash'ari theologians led by Al-Ghazali. Although highly regarded as a legal scholar of the Maliki school of Islamic law, Ibn Rushd's philosophical ideas were considered controversial in Ash'arite Muslim circles.
Ibn Rushd had a greater impact on Christian Europe: he has been described as the "founding father of secular thought in Western Europe" and was known by the sobriquet the Commentator for his detailed emendations to Aristotle. Latin translations of Ibn Rushd's work led the way to the popularization of Aristotle.
